What to Do If You Have a Car Accident with an Uninsured Driver

Dealing with a car accident is already stressful, but if there’s something that Australian drivers fear more, it’s uninsured drivers. Getting hit by an uninsured driver makes the situation more complicated. If the other driver is not insured, you may be left wondering about how to go about getting your compensation.

In these accidents, you need to remain calm and not let your emotions add to the stress. You can do this by knowing how to handle the situation, and this guide walks you through exactly that.

Who Is an Uninsured Driver?

In Australia, a driver is uninsured when they’re operating any vehicle without a valid car insurance policy. All Australian states and territories require drivers to have compulsory third-party car insurance. Besides this, if a driver also has comprehensive car insurance or third-party property damage coverage, they’re insured enough to cover damages.

Common Reasons Drivers Are Uninsured

There can be many reasons why drivers don’t have car insurance, some of the most common ones being:

Can’t afford compulsory third-party or comprehensive insurance

Forgetting to renew their insurance details

Unaware that they need insurance

Driving an unregistered or unlicensed vehicle, which automatically voids the car insurance policy

Risks of Being Hit by an Uninsured Driver

The risks of a car accident when the other driver has no insurance are mostly financial. You cannot claim against the other driver’s insurance company; you’ll have to deal with the at-fault driver directly to recover repair costs, medical expenses, and any other compensation for damages from the collision. This can complicate cost recovery, as there’s no guarantee that the other driver will agree to pay.

Uninsured vs. Underinsured: What's the Difference?

An uninsured driver has no insurance whatsoever, while an underinsured driver has insurance that is insufficient to cover the damage they have caused. For example, if they have compulsory third-party coverage, they can only cover costs related to injuries, not to any vehicle or property damage.

Immediate Steps to Take If You Are Hit by an Uninsured Driver

If you have been in a motor vehicle accident with an uninsured driver, here’s what you need to do:

Ensure Safety and Move to a Safe Location

As per Australian law, you must ensure everyone’s safety first. Check yourself and others for any injuries, especially bleeding or unconsciousness. If possible, move your vehicle to the side of the road to prevent secondary collisions.

Call the Police and File a Report

Notify the police as soon as you can. The police report will be a crucial piece of evidence when filing your car insurance, further solidifying your case for compensation recovery.

Collect Evidence and Take Photos

Since the other party has no car insurance, you can’t rely on them for a quick settlement. You need every piece of evidence possible to prove that the accident wasn’t your fault, so take detailed videos and photos of the following:

The vehicles involved, including close-ups of the damages

Surrounding road conditions

Any road signs where the accident happened

The vehicles’ registration plates with the numbers clearly visible

CCTV cameras around the area, if any

If possible, you should also gather witness statements and their contact details. Statements from eyewitnesses serve as strong evidence that you can use to prove who was responsible for the accident.

Exchange Details—Even If the Other Driver Is Uninsured

Even when the other driver is uninsured, the law requires you to exchange details with them. Swap full names, phone numbers, address details, and licence numbers. When they say that they don’t have insurance, don’t panic. Just ensure that their contact details are correct.

Notifying Your Insurance Company

In these accidents, it’s crucial to notify your insurer immediately. Once you’ve completed the steps above, contact your insurer to start the insurance claim process.

Understanding Your Coverage Options

How the claims process goes will depend on your insurance coverage. If you have comprehensive car insurance, your insurer will typically cover the damages, even when the other driver is uninsured. It’s on them to deal directly with the driver for compensation. However, if you only have compulsory third-party insurance or third-party property coverage, your options can be limited.

Filing a Claim for Damage or Injury

When filing your claim, follow your insurer’s guidelines. Provide all the evidence you’ve gathered and follow protocol, which will usually include a vehicle assessment before the claim approval.

Determining Fault in Accidents Involving Uninsured Drivers

Determining fault remains vital to how insurance claims proceed, even when uninsured drivers are involved. Here’s how this looks:

How Fault Is Decided in Australia

Just because the other driver is uninsured doesn’t mean they’re automatically at fault. Insurers look at the evidence provided and assess the prevailing road rules to decide who caused the accident.

Impact of Being at Fault vs. Not at Fault

If you didn’t cause the accident and you have comprehensive insurance, you may not have to pay anything for repairs (other than the excess). However, when the driver responsible for the accident is uninsured, they’re responsible for covering costs like repairs, medical bills, and other legal expenses if the other party seeks compensation through court.

Compensation Options When the Other Driver Is Uninsured

When the other driver is uninsured, there are generally three options for compensation:

Your own comprehensive car insurance coverage

An “uninsured driver extension” feature, if included in your insurance policy, which covers a limited amount for accident repairs if the other driver accepts fault and is uninsured

Taking legal action to recover costs

Preventing Future Problems With Uninsured Drivers

Since accidents are unpredictable, the only way to prevent future problems with uninsured drivers is to have a solid insurance policy. Comprehensive insurance works best, as it gets you compensation even when the other driver has no insurance. Some insurers even waive excess for comprehensive coverage, which saves you even more money down the road.

How Right2Drive Helps After a Not-at-Fault Accident

At Right2Drive, we help those who are not at fault in accidents regain their mobility. We provide comparable accident replacement vehicles after we receive the contact details for the other driver and they accept fault.
