How Many Demerit Points for Speeding in NSW? Full Rules, Fines & Breakdown

In New South Wales, speeding contributes to about 40% of road fatalities and 25% of serious injuries each year. The rules are enforced strictly, and every infraction has a clear and measurable impact on your driving record. In this article, we will explain the penalties for speeding offences in NSW so you can understand how the system works.

When another driver is speeding and causes an accident, it often leaves the person who wasn’t at fault without transport at short notice. Right2Drive can bridge that gap: we can help you get back on the road with a suitable replacement car and recover hire costs directly from the other driver’s insurer.

Demerit Points for Speeding in NSW

Speeding offences in NSW result in both fines and demerit points that can affect your ability to keep your licence. Here’s what you need to know:

How the NSW Demerit Points System Works

The demerit points system in NSW aims to encourage safe and responsible driving behaviours. When a driver is caught speeding, a set number of demerit points is added to their record based on the severity of the offence.

All speeding offences committed by learner and provisional licence holders carry at least 4 demerit points, while all drivers face harsher penalties if caught within a school zone.

Each type of licence has a maximum number of points you can accumulate within a set period. Your licence can be suspended if you reach or exceed the limit: 13 points for unrestricted licence holders, 7 for P2, and 4 for P1 and learner drivers.

Demerit points are recorded from the date of the offence, not the date the fine is issued.

Do You Always Get Demerit Points for Speeding?

There are very limited situations where demerit points may not apply. For example:

Revenue NSW may issue a caution instead of a fine and demerit points if a driver has a 10-year clean driving record and the speed was less than 20 km/h over the limit. This process is not automatic; you must formally request a review through Revenue NSW. Leniency does not apply to school zone offences.

If a driver successfully challenges the infringement in court and is found not guilty, no penalties or demerit points are applied.

If the registered owner was not the driver, they may nominate the person responsible for the offence. The points are removed from the owner’s record and transferred to the actual driver.

It is important to understand that paying a fine does not remove the demerit points. Once the offence is recorded, the points are applied automatically to your licence.

Fine and Demerit Points for Speeding Offences

The penalties for speeding increase progressively based on how much you exceed the limit. Lower-level offences result in smaller fines and fewer demerit points, while higher speeds carry significantly harsher consequences.

In more serious cases, such as excessive speeding, additional penalties may apply. These can include immediate licence suspension or court-imposed sanctions. Penalties are also stricter during double demerit periods (typically public holidays and long weekends).

How Many Demerit Points for Speeding Under 10 km/h in NSW?

Driving less than 10 km/h over the limit might seem minor, but it is a major contributor to road fatalities. According to Transport for NSW, most speeding deaths in the state occur at these low-level speeds.

Demerit Points for Speeding up to 10 km/h Under the Limit

Full licence holders will receive 1 demerit point for exceeding the speed limit by up to 10 km/h in NSW. This applies to most standard roads and conditions.

While one point may not seem significant, repeated low-level offences within a three-year period can still lead to licence suspension if you reach the maximum allowed points for your licence type.

Applicable Fine and Penalty Details

Drivers will be fined $149 for speeding up to 10 km/h over the limit. In a school zone, the same offence results in a fine of $246.

Double Demerit Periods and Their Impact

Double demerits typically apply during public holiday periods and are enforced to encourage safer driving when traffic volumes are higher. These dates are announced in advance and apply across the state.

During this time, a low-level speeding offence that would normally result in 1 point will instead result in 2 demerit points, which means even a single violation can have a greater impact on your driving record, especially if you already have points accumulated.

How Many Demerit Points for Speeding Over 10 km/h in NSW?

Fines and demerit points escalate based on how far over the limit you are driving. These higher penalties reflect the increased risk of serious crashes at greater speeds.

Demerit Points for 10–20 km/h Over the Speed Limit

If a driver exceeds the speed limit by more than 10 km/h but less than 20 km/h in NSW, they receive 3 demerit points and are fined $345. The penalty increases to 4 demerit points and $443 for the same offence in a school zone.

Demerit Points for 20–30 km/h Over the Speed Limit

Drivers caught speeding between 20 km/h and 30 km/h over the limit receive 4 demerit points and are fined $592. In a school zone, the penalty increases to 5 demerit points and $738.

Demerit Points for 30–45 km/h Over the Speed Limit

Exceeding the speed limit by 30 km/h to 45 km/h results in 5 demerit points and a $1,133 fine. The same offence carries a penalty of 6 demerit points and a $1,429 fine in a school zone.

This is a serious speeding offence that triggers a three-month licence suspension.

Demerit Points for More Than 45 km/h Over the Limit

Driving more than 45 km/h over the speed limit is classified as extreme speeding and results in 6 demerit points and a $3,054 fine. In a school zone, the penalty increases to 7 demerit points and $3,242.

This is one of the most serious speeding offences short of dangerous driving charges. It results in a six-month suspension. The police can confiscate your licence on the spot, and they also have the right to impound your vehicle or confiscate your vehicle's number plates.

NSW Speeding Fines and Demerit Points Breakdown

Speeding penalties in NSW are structured so that both fines and demerit points increase in line with how far over the speed limit a driver is travelling. This system is designed to reflect risk levels on the road, with higher speeds carrying significantly greater consequences.

Speed Range vs Fine Amount vs Demerit Points

The key difference is not the penalty but the demerit point limit.

Learners (L plates) and P1 drivers (red Ps) are allowed 4 demerit points, while P2 drivers (green Ps) have a demerit limit of 7 points.

All speeding offences committed by learner or provisional drivers result in at least 4 demerit points. Additionally, the police can suspend and confiscate their licences immediately if they speed by more than 30km/h over the limit.

Do You Get Demerit Points for Every Speeding Fine?

Yes. You will accrue demerit points for every speeding fine you pay, and reaching the limit for your licence type results in an automatic suspension.

Situations Where Demerit Points May Vary

The number of points will vary depending on the circumstances of the offence, the type of licence you hold, the location, and the timing of the offence. For example:

An unrestricted driver will receive 1 point for speeding by 10km/h or less, but a learner or provisional driver will receive 4 points for the same offence.

Speeding offences in school zones result in increased penalties for both fines and demerit points.

Demerit points for speeding are doubled during designated periods.

Heavy vehicle drivers face higher fines or point accruals.

Camera-Detected vs Police-Issued Speeding Fines

The method of detection does not change the number of demerit points assigned for speeding. However, the enforcement process differs.

NSW police have the authority to issue an immediate licence suspension at the roadside for speeding by more than 45 km/h (or 30 km/h for L/P platers). They can also impound your vehicles or confiscate your number plates.

Camera-detected offences are processed and mailed by Revenue NSW. A suspension notice is only issued by Transport for NSW after the fine is paid or the time to elect a court hearing has passed.

Speeding Accidents: How Right2Drive Can Help

Speeding increases both the likelihood of a crash and the severity of damage. If you’re involved in an accident that wasn’t your fault, the disruption to your routine can be immediate: getting to work and managing school runs can be difficult when your car is undrivable.

Right2Drive can provide you with a suitable replacement vehicle that matches the size and type of your car as closely as possible, so you’re not left waiting without transport during a stressful time. You can use the loan car while yours is being repaired or your claim is settled. We can also organise delivery and collection from your home, workplace, repair shop, or any location convenient to you.

We work with the other driver’s insurance company to recover the costs of the hire. This means our customers don’t pay upfront and are only responsible for fuel, tolls, and infringements.

Frequently Asked Questions

How many demerit points can you get before a licence suspension in NSW?

Unrestricted licence holders can accumulate up to 13 demerit points within a three-year period before their licence is suspended.
