Luxury Car Rental After a Crash: When to Upgrade Your Replacement Vehicle

Being in a car accident can be extremely unsettling, especially if you are not at fault. There are already enough responsibilities to take care of when suddenly you have to think about lodging insurance claims, assessing the damage caused for making arrangements for repairs, and figuring out a way to remain mobile while your vehicle is being repaired at the car shop. But should you upgrade to a luxury car instead of going for a standard model?

In this post, we explore situations where hiring luxury replacement cars makes sense. Read on to understand your rights after a car accident and find out what steps you should take should you decide to choose a premium vehicle to help you get around the city.

Understanding Your Rights After a Car Accident

If the accident was due to no fault of yours, you may exercise your right to be put back in the position you were in before the accident happened. This means you should be provided with a replacement car that is comparable to your own in terms of size and type, and that too at no cost. For example, if you drive a Toyota Prado, it is within your rights to expect a replacement car in a similar class.

This provision is in accordance with Australian law, which entitles not-at-fault drivers to a vehicle that matches the class, size and quality of their own car. This ensures that you can get back on the road and carry on with your routine life, managing family and work responsibilities as always. As for the damages, the other party (the driver at fault for the accident) is bound by law to cover the costs associated with the accident, generally doing so through their insurance company.

What Qualifies as a Luxury Replacement Vehicle?

If you have seen high-end vehicles from brands like BMW, Mercedes-Benz, and Lexus, you already know that these cars are incomparable to standard cars. This is because luxury cars are fitted with premium features and designed with state-of-the-art technology to deliver superior performance. Therefore, a luxury replacement vehicle is one that offers greater comfort and better performance on the road.

Here are the features you can typically expect to see in a luxury vehicle:

Interiors made of high-quality materials (leather seats and metal accents)

Infotainment systems

Advanced safety technology

Large, comfortable cabins

For someone who has been in a car accident due to no fault of their own, choosing a luxury ride for premium comfort and driving experience may be a way to feel normal again after a stressful incident.

Your Legal Right to a Luxury Replacement in Australia

In Australia, if you are the not-at-fault party in a car accident, you are entitled to request your insurer to send you a comparable replacement vehicle. However, a luxury model is usually only considered comparable if your damaged vehicle was of a similar class. For example:

If you own a luxury vehicle like a Lexus LX, you can expect a comparable model.

If you drive a standard model, you can only ask for a similar model.

That said, you do have the option to upgrade to a luxury car even if your own vehicle is not classed as premium. In this case, you will most likely be responsible for bearing additional hire costs over and above the amount recoverable from the at-fault driver’s insurer.

How the Luxury Car Replacement Process Works

Many people choose to hire luxury cars for temporary use through their insurer or a premium car rental service to minimise disruption to their lives after a car accident. They may do so when:

They are preparing for an important business trip

A special occasion or commitment calls for an impressive ride (like an upcoming wedding or frequent corporate events)

Companies need to transport clients

No matter your reason, the process can be completed in these simple steps:

Contact Provider/Apply Online

Contact a provider online or by phone and discuss your requirements with them. Be as specific as possible, letting them know that you want one of the latest premium vehicles (name a brand and model, if possible) or if you are fine with choosing one from their extensive range of existing fleet.

Submit Proof of the Not-at-Fault Accident + Driver Details

Provide them with the necessary documentation, such as the insurance policy and the report that confirms you were not at fault, along with the other driver’s details and insurance information. This step helps validate the claim.

Insurance Liaises Directly with Provider

Once all information is shared, the provider will work with the other party’s insurance company to manage all approvals and cost recovery on your behalf.

Vehicle Delivered and Arranged

The replacement vehicle, whether you choose a luxury SUV or something among supercars for a special event, is delivered to where you need it, be it at the Sydney Airport or your home in Gold Coast.

Return When Your Car is Repaired or Written Off

When your vehicle is repaired or your claim is finalised, you can request the replacement vehicle’s collection. Maintain clear communication to make this step easy.

How Long Can You Keep the Luxury Rental?

Generally, the rental period for the luxury replacement vehicle lasts as long as your car repairs take or until your vehicle is written off as a total loss. In case of a total loss, the rental period may extend until you receive a settlement from the at-fault party.

Sometimes, repair work can experience delays due to the unavailability of parts or additional damage coming to light. It’s important to maintain consistent communication with the provider so that they can update the insurer to keep everything moving smoothly.

Potential Issues and How to Avoid Them

Getting a luxury upgrade to your replacement car is usually straightforward, but there are some things you should steer clear of:

Failing to account for high fuel and operating costs, as a premium car consumes more fuel

Not considering the practicality of hiring a luxury vehicle for day-to-day commitments

Ignoring the need to confirm in writing what costs are being covered by the at-fault driver’s insurer and what costs will be your responsibility

Conclusion

Accidents are never easy, but you should not let them derail your life routine. It is well within your rights to make an insurance claim and ask for a replacement car, whether it is an everyday model or something premium. If you initially choose a standard vehicle but want to upgrade to a luxury model later on, make sure that you select a provider that prioritises transparency in every deal they make.

If you have questions about the process, are unsure about your rights as a not-at-fault driver or simply don't know where to start looking for available options, partner with us so that we can help you check your eligibility, apply for a replacement car, and get back on the road today.

Frequently Asked Questions (FAQs)

Can I Get a Luxury Replacement If It's My Fault?

If you are at fault in a car accident, you are not legally entitled to a replacement car. Your insurer will only cover the repair costs of your damaged car and even the other party's damages, but you will not be able to claim a replacement car.

Will Insurance Cover a Premium Replacement Car?

A replacement vehicle can only be claimed if you are the not-at-fault party in an accident. The replacement car is a comparable model to what you own, but if you upgrade to a luxury model, you will need to pay the difference between the standard and premium hire rates.

Can I Select the Model of My Luxury Replacement?

Yes, in many cases, it is possible to request a specific brand or model, like a Tesla model, but it is subject to availability. It is best to check with the provider first and let them know your preferences so they can ensure you get the perfect vehicle.

What Happens If Repairs Take Longer Than Expected?

If repairs take longer than expected, rest assured that your entitlement continues for the prolonged duration. If the delay is unreasonably long, you can seek repairs at another car shop and charge the bill to your insurer, if this is a provision in your agreement with them.

{"@context":"https://schema.org","@type":"FAQPage","mainEntity":[{"@type":"Question","name":"Can I Get a Luxury Replacement If It's My Fault?","acceptedAnswer":{"@type":"Answer","text":"If you are at fault in a car accident, you are not legally entitled to a replacement car.
